The short version

Who we are and what these terms cover

Black Rune LLC, trading as Black Rune Studios (“we”, “us”), makes these games. These terms apply to every mobile game we publish, on every platform, including updates. By downloading or playing one of our games you agree to them. If you do not agree, please do not play.

If you got a game from the Apple App Store, Apple’s Licensed Application End User License Agreement governs your licence to it, and these terms add to that agreement wherever the two do not conflict. If you got a game from Google Play or anywhere else, these terms are your licence. Each store’s own terms also apply to your use of that store.

Your licence to play

We grant you a personal, non-exclusive, non-transferable and revocable licence to download and play our games on devices you own or control, for your own non-commercial entertainment.

The games, and everything in them, belong to us or to the creators who license content to us. You get the right to play. You do not get ownership of a game or of anything in it.

Game content, including content from other creators

Our games contain music, sound effects, artwork, animation, text and code. We make some of it ourselves and license some of it from other artists and creators. All of it is provided to you only as part of the game.

• You may enjoy that content only as it plays inside the game, as we distribute it.
• You may not extract, rip, copy, export or otherwise take any of it out of the game by any means, including by unpacking the app’s files.
• You may not use any of it outside the game: not in your own projects, videos, music, apps or products, and not as a file on its own.
• You may not sell, share, upload or redistribute any of it.

The creators who license content to us rely on these limits, so they matter to us as much as to them.

Other things you may not do

• Copy, sell, rent, lend or redistribute our games or their files.
• Reverse-engineer, decompile, disassemble or modify our games, except where the law gives you that right regardless of these terms.
• Use cheats, mods, bots or other tools that change a game or get around its ads, purchases or rewards.
• Use our games in any way that breaks the law or harms other people.

Purchases

Some games offer optional purchases, such as an upgrade that removes ads. Purchases are made through, and processed by, the App Store or Google Play under their terms. We never see your payment details. Refunds are handled by the store you bought from, under its refund policy.

A one-time upgrade belongs to the store account you bought it with. If you reinstall a game, or move to a new device signed in to the same account, use the game’s Restore option to get it back. We keep purchased upgrades working for as long as we support a game, but we cannot promise that any game will be available forever.

In-game currency and items

Currencies and items you earn by playing, such as Research Points and cosmetics in Nova’s Lab, are part of the game. They have no cash value. They cannot be sold, transferred, or exchanged for money or for anything outside the game, and they are stored only on your device.

Ads

Our games are free to play and are paid for by advertising from Google AdMob. Rewarded ads are always optional. Ads come from third parties, and we are not responsible for the products or services they promote. How advertising data is handled is explained in our Privacy policy.

Your progress

Your progress, settings and earned items are saved only on your device. We do not run accounts or cloud saves, so we cannot recover progress lost when you delete a game or reset or replace your device. Purchases can be restored through the store, as described above.

Updates and availability

We may update, change or stop offering a game or any feature of it, and some updates may be needed to keep playing. We work to keep our games running well, but we do not promise that any game will always be available, free of errors, or compatible with every device.

Ending these terms

You can stop at any time by deleting the game. If you break these terms, your licence ends automatically, and you must stop playing and delete the game. The sections on ownership, game content, disclaimers, liability and governing law continue to apply after your licence ends.

Disclaimers and liability

Our games are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for lost data. Our total liability to you for anything relating to our games is limited to the greater of what you paid us for the game or purchase concerned in the 12 months before your claim, or US$50.

Nothing in these terms limits or excludes any rights you have under consumer law that cannot be limited or excluded, including, where they apply, rights relating to faulty digital content.

Children

Our games are made for a general audience. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you and should supervise any purchases.

Changes to these terms

If these terms change, the effective date above will change and the updated version will be published on this page. If a change is material, we will say so here before it takes effect. Continuing to play after a change takes effect means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-law rules. Any dispute will be heard in the courts of Colorado, unless the law of the country where you live gives you the right to bring it in your local courts, or gives you consumer protections that cannot be overridden.
